We can provide a copy of our final assessment of your loan application on request, at no charge to you (n accordance with Section 132, National Consumer Credit Protection Act.

Contract suitability or unsuitability details.

  • To comply with the National Consumer Credit Protection Act 2009 (Sections 128 and 129) we are obliged to assess whether or not the credit contract you seek is suitable or unsuitable.
  • Section 131 obliges Installment Loans to advise you if we are unable to extend credit to you, and if that loan is unsuitable.
  • "unsuitabiity " is assessed using the criteria below:

  • Your ability to meet the financial obligations of the loan contract without undergoing financial hardship.
  • If the contract is able to meet your objectives and requirements
  • If the contract meets the requirements that are imposed by regulations, as amended from time to time.
  • As a credit provider, we are involved in making enquiries regarding your financial circumstances
  • Whether we believe that the information provided to us is true.

Our involvement in this process as a credit provider is to make enquiries regarding your financial circumstances and assess whether or not the information available is accurate. This process involves us, as a credit provider.

Collection of Information.

I consent to providing the entity with my personal and credit information and allowing them to collect this information from me.

I understand that if do not provide all the information requested for my application from the entity that they may not be able to provide me with their service.

I understand that it is my responsibility to advise the entity if any of my personal information and contact details should change.

Use of information

I consent my information being collected by the entity for the provision of referral and marketing services, and any other related purpose including but not limited to:

  • Customer service - accessing and updating my personal information, resolving disputes.
  • Information gathering and statistical data for the evaluation of business functions.
  • To ensure the is legal compliance under the relevant acts such as:
    • National Consumer Credit Protection Act 2009
    • Privacy Act 1988
    • Anti-Money Laundering and Counter-Terrorism Financing Act 2006.
  • Developing services and improving business processes and efficiency.

Disclosure of information

I consent to the disclosure of my personal information by the entity for the provision of referral and marketing services, as well as any other related purpose (as outlined above) ongoing to:

  • Credit brokers, credit providers, referrers and other service providers
  • The entity's contractors, agents, auditors, insurers, lawyers and financiers.
  • Any other entities or persons whom you consent to.

I understand that my information may disclosed for other purposes which are outlined in the Privacy Policy.

Information exchanged with other providers.

By providing my consent to exchange to exchange my information with credit providers and brokers, referrers and service providers, I understand that this information may be sold to them or disclosed to them for a fee.

The dollar value of the fee is determined on referral.

I understand:

  • Where my information is being exchanged.
  • That my information is being exchanged for any of the purposes for which I gave consent to the entity. This includes them offering me their services and products

By giving consent to exchange my personal and credit information with credit brokers, credit providers, referrers and service providers, I am consenting to the entity exchanging all of my application details such as:

  • Types of loans I have
  • Amount borrowed
  • How well I meet my loan payment obligations.
  • If I have committed any serious credit infringements e.g. fraud.

Third party promotions of products and services

I consent to being contacted by the entity and external third parties/agents acting on their behalf to promote their own and their marketing partners products and services.

I understand that I can contact the entity any time to withdraw my consent and request not to be communicated for promotional reasons.

Information exchange with Credit Reporting Bodies

I give my explicit and informed consent to the entity exchanging my credit and personal information with credit reporting bodies.

By giving my consent to this I understand that the entity may collect information about me from credit reporting bodies.

Electronic Communications

I consent to all communication between myself and the entity to be through electronic communications (where possible). This includes but is not limited to:

  • Information requests regarding credit applications
  • Contract variation requests
  • Disclosure documents included but not limited to:
    • credit guides
    • information statements
    • copy of assessments
    • credit contract documents
    • variations of these and credit contract offers
  • Notices such as:
    • missed payment notices
    • default notices
    • final notices
    • settlement notices
    • account statements;
  • marketing materials and promotions;
  • any other communications, information, or documents that must or will be provided to you or which you have requested.

By giving my consent to receiving electronic communications I understand that:

  • I will receive communications via any electronic method such as SMS and email
  • My electronic communications e.g. mobile phone, email inbox must be checked regularly for messages, information and documents;
  • I am responsible for the security of my electronic communications;
  • I may no longer receive any paper-based documents.
  • consent from the entity to send me documents via electronic communication methods may be withdrawn at any time.

Commercial Electronic Messages

To comply with the Spam Act 2003, I understand that I must give my consent before the entity is permitted to communicate with me using electronic messages.

I give my consent to the entity to communicate with me via commercial electronic messages (email, SMS, fax) for the purpose of providing convenient and fast communications for me.

Electronic Bank Statement Retrieval

By completing an application, I am consenting to the lender using an electronic statement retrieval solution to collect my statements and information on my behalf. (If you do not agree you should not be using this service).

I understand one or all of the statements retrieval providers below may be used;
